California Court Upholds Pesticide Drift Ruling

In a case that may have broad implications for the millions of Americans impacted by toxic pesticides that wind up off target, a California court upheld a ruling in favor of an organic farmer: http://organicfood.einnews.com/article/1088-organic-farmer-wins-1-million-suit-over-pesticide-contamination.

This decision is especially significant because the defendant in the case is believed to have applied to pesticides legally. Attorneys for the defendants argued that it should not be their responsibility if the pesticides inadvertently caused harm elsewhere, yet California’s 6th Appellate District Court disagreed.

My guess is this case is headed for a higher level of appeal and will draw an intense level of lobbying and scrutiny from the chemical pesticide industry. It bears watching.
